Supreme Court refers back bail application for MDC members to High
Court

Supreme Court judge and the Deputy Chief Justice, Luke Malaba today
referred back to the High Court the bail application of seven MDC
members who had applied for bail at the Supreme Court.
Tungamirai Madzokere,
Glen View Ward 32 councillor, Rebecca Mafikeni, Phenias Nhatarikwa,
Lazarus Maengahama, Stanford Maengahama, Yvonne Musarurwa and Stanford
Mangwiro have been in remand prison for six months on false charges
of murdering a police officer in Glen View in May.
The seven had
applied for bail at the Supreme Court after High Court judge, Justice
Tendai Uchena had turned down their bail application in July citing
they were a flight risk.
However, Justice
Malaba referred the matter back to the High Court saying that the
seven have to first notify the High Court of their intention to
appeal at the Supreme Court.
Meanwhile, the
High Court will next Wednesday, consider a fresh bail application
filed by Solomon Madzore, the MDC Youth Assembly chairperson whose
first bail bid was barred by High Court judge, Justice Hlekani Mwayera
last month.
Madzore, who
is facing similar charges and is detained at Chikurubi Maximum Prison,
is not among those who applied for bail at the Supreme Court as
he was arrested after the application had already been made.
The eight are
part of 28 MDC members who were arrested in connection with the
police officer's death. The others were granted bail in July.
The police officer
was murdered by unknown revellers at a night club in Glen View in
May.
